Power of Attorney

Prior to the performance of the act, the Notary should be provided with the following information:

  • details of the Principal (person who intends to grant the power of attorney), i.e.: given names, surnames, parents’ given names, series and number of the identification document, PESEL, NIP, marital status, place of residence, and in the case where the Principal is a legal person (or other entity) – full business name/name with the details of representatives, registry numbers, REGON, NIP, address of the registered office
  • details of an Attorney or Attorneys, i.e.: given names, surnames, parents’ given names, PESEL, place of residence
  • if the intention is to appoint several Attorneys – information whether each of the Attorneys may act independently or whether they may only act jointly
  • scope of power of attorney – powers given to an Attorney (in which cases he shall be authorized to represent the Principal)
  • information whether the power of attorney shall be given for a specified period of time

In order to grant a power of attorney it is obligatory that the Principal appears in person; appearance of the attorney is not necessary.
